Notice of Rulemaking Material Availability 

Revisions to Rule 901, New Source Performance Standards and  
Adoption of a “Negative Declaration In Lieu of Rules”    

Project Description

The Santa Barbara County Air Pollution Control District (District) proposes to update Rule 901, New Source Performance Standards (NSPS), to make it current.  The District is also finalizing a “Negative Declaration In Lieu of Rules” for certain federal emission guidelines because there are no sources in our area subject to them.   

Sources Potentially Affected

No sources will be affected by the adoption of the revised Rule 901 or the “Negative Declaration in Lieu of Rules.”                                                        

Public Comment

The District is soliciting comments on these projects.  You may submit written comments to the project manager identified below.  The District has not yet established a formal comment period for these projects.  The formal comment period is tentatively scheduled to start on July 18, 2010 and to end on August 14, 2010.  The District will publish a public notice in the future that indicates the formal comment period.  

Project Details

The District is revising Rule 901 to incorporate by reference all of the federal 40 Code of Federal Regulations (CFR), Part 60, Standards of Performance for New Stationary Sources.  40 CFR Part 60 requirements apply to sources regardless of whether they are listed in District Rule 901.  After the Board approves the Rule 901 update, the District will request delegation of authority from the U.S.EPA to implement and enforce the applicable NSPS.   

40 CFR, Part 60, also includes standards of performance for certain existing sources that would be subject to a new source performance standard if such sources were new sources.  These standards of performance are referred to as “Emission Guidelines” (Guidelines).  The District is unaware of any sources within its jurisdiction that are subject to the following Guidelines:  Subpart Cb (Large Municipal Waste Combustors), Subpart Cd (Sulfuric Acid Production Units), Subpart Ce (Hospital/Medical/Infectious Waste Incinerators), Subpart BBBB (Small Municipal Waste Combustion Units), Subpart DDDD (Commercial and Industrial Solid Waste Incineration Units), Subpart FFFF (Other Solid Waste Incineration Units), or Subpart HHHH (Coal-Fired Electric Steam Generating Units).  Once the District adopts the “Negative Declaration in Lieu of Rules,” staff will submit the “Negative Declaration in Lieu of Rules” for inclusion in the California State Plan.  

Project Schedule

The tentative schedule is for the District to discuss these projects at the July 14, 2010 Community Advisory Council meeting and to present revised Rule 901 and the “Negative Declaration in Lieu of Rules” for adoption at a Board Hearing sometime in the fall of this year.  Please check our website for confirmation of these meetings.

Please provide written comments to the project manager, Douglas Grapple via this email: GrappleD@sbcapcd.org.  Although the formal written comment period for these projects has yet to commence, the District requests that written comments be provided by July 12, 2010 to allow staff to formulate a response before the July 14, 2010 Community Advisory Council meeting.
