Notice of Public Hearing

Proposed New APCD Rule 213, “Fees for Registration Programs”

The Santa Barbara County Air Pollution Control District (APCD) will hold a public hearing at the time and location listed above to accept comments and consider adoption of proposed new Rule 213.

Summary

New Rule 213, “Fees for Registration Programs,” sets a registration fee and registration renewal fee of $200.00 for each engine subject to Rule 1201, “Registration of Agricultural Diesel Engines.” This fee may be adjusted annually based on the California Consumer Price Index.

The APCD Board of Directors held a public hearing to receive public testimony on Rule 213 on August 16, 2007 and will consider Rule 213 at its October 18, 2007 meeting. The Board will consider adopting Rule 213 as presented at the August 16, 2007 hearing but may also consider alternatives, including an option that will propose assessing lower fees for emergency standby engines ($100.00 per engine) and lower-polluting Tier III and Tier IV engines ($100.00 per engine) and higher fees for Tier 0, Tier 1, and Tier 2 engines ($243.00 per engine). If the Board elects to pursue this alternative fee option, the Board will hold another public hearing to consider that option on December 20, 2007.

Pursuant to the California Environmental Quality Act (CEQA), the APCD has prepared a Notice of Exemption for Rule 213.
