1)     Case No. 12-10-AP - Respondent:  Venoco Inc. 6267 Carpinteria Ave., Suite 100, Carpinteria, CA  93013
Hearing – On June 2, 2010, Venoco Inc. submitted a “Petition for Appeal of Permit to Operate”, as to whether the Control Officer properly issued Permit to Operate (PTO) No. 4441-R4 dated May 4, 2010 for operation of the Ellwood Seep Containment Project, located on State PRC Lease 3242.1 (South Ellwood Offshore Field, Santa Barbara County, California State Tidelands), and which Project is owned jointly by Venoco and ConocoPhillips and operated by Venoco.  Petitioner has since come to an agreement with District staff to modify the PTO. On June 1, 2011, Petitioner withdrew the Petition for Appeal.

Hearing – To consider an application by MM Tajiguas for a Regular Variance from Permit Conditions 9.C.2(b)(iv), 9.C.3(b)(vi), and 9.C.3(b)(vii) of Permit to Operate 9788-R2.  MM Tajiguas operates a combustion system for collected landfill gas at the Tajiguas Landfill.  An increase in the heat content of the landfill gas has resulted in exceedences of heat input limits for an internal combustion (IC) engine and flare, and exceedences of the minimum residence time limit for the flare.  Petitioner wishes to obtain a variance to continue to combust the landfill gas in the IC engine and flare while permit modifications are made.  No excess emissions are anticipated during the variance period.

Hearing – To consider an application by ExxonMobil Production Company (Petitioner) for a Regular Variance from District Rule 359.D.2.b.1.  The Petitioner operates a flare for the purpose of burning high pressure sour produced gas on Platform Heritage and is seeking variance relief to operate the flare system without the #2 pilot being lit.  Two of the three pilots are still operational, and the igniter system for the extinguished pilot can be used to re-light the flare flame while the pilot/igniter assembly is being repaired.  The granting of Petitioner’s variance request will not result in excess pollutant emissions in that the #2 pilot remains plugged and not capable of emitting any air contaminants.  On July 24, 2008 the Petitioner sought and was granted Interim Variance 25-08-I until October 19, 2008, or the date of decision of the Hearing Board on this application.

Hearing – To consider an application by ExxonMobil Production Company (Petitioner) for a Regular Variance from District Rule 206, Condition 9.C.2(c)(iv) of Part 70 Permit to Operate 9100 and Rule 359.D.2.b.1.  The Petitioner operates a flare for the purpose of burning high pressure sour produced gas from Platform Hondo’s flare gathering system.  The platform is located approximately 15 miles west of the City of Santa Barbara.   The flare consists of three pilot/igniter assemblies surrounding a flare tip on the end of the flare boom.  The Petitioner is required to ensure the presence of a flame in the pilot of the flare be continuously monitored using a thermocouple or an equivalent device that detects the presence of a flame.  On May 5, 2008 the Petitioner sought and was granted Emergency Variance 12-08-E until May 19, 2008 due to the failure of the #2 pilot.  On May 20, 2008 the Petitioner sought additional variance protection through April 30, 2009 by filing a Petition for both an Interim Variance and Regular Variance (Case Nos. 13-08-I/14-08-R) due to a faulty thermocouple on the #2 pilot.  The faulty thermocouple cannot be replaced without a complete shutdown of Platforms Hondo, Harmony and Heritage and isolation of the flare system.  A field-wide shutdown is scheduled to occur in March 2009. The granting of Petitioner’s variance request will result in minimal excess pollutant emissions in that should the pilot extinguish, it would be relit quickly due to it close proximity to the continuous flare flame.                

2)         Case No. 17-08-R –All Ways Drilling, Inc., 4110 E. Ventura Blvd., Camarillo, CA 93011              

Hearing – To consider an application by All Ways Drilling (Petitioner) for a Regular Variance from the Airborne Toxic Control Measure (ATCM) for diesel particulate matter from portable engines rated at 50 horsepower (hp) and greater and APCD Rule 333.  Petitioner wishes to operate two diesel-fueled deck engines (approximately 90 and 180 hp) on portable drilling rigs in violation of the ATCM until new engines that comply with the applicable regulatory requirements can be obtained.  Interim Variance 16-08-I was approved on June 19, 2008.  Anticipated duration of the Regular Variance is until December 31, 2009.

During the months of October and November 2007, the Petitioner experienced five NOx emission excursions resulting in approximately 1.10 lbs. excess emissions of NOx for each incident. The Petitioner has been operating the gas turbine generator under an Emergency and 90-Day Variance since November 21, 2007 and is seeking additional variance protection until April 30, 2009 or the scheduled 2009 facility shutdown, whichever occurs first. 2) Case No. 07-08-R – ExxonMobil Production Company P.O. Hearing – To consider an application by ExxonMobil Production Company (Petitioner) for a Regular Variance from District Rule 359.D.2.b.1 and b.3. The Petitioner operates a flare for the purpose of burning high pressure sour produced gas from Platform Harmony which is located approximately 18 miles west of the City of Santa Barbara, CA. Due to malfunctioning of the pilot/igniter assemblies, Petitioner was granted an Emergency Variance on January 10, 2008. On February 8, 2008, the Petitioner sought additional variance protection through April 30, 2009 by filing a Petition for both an Interim (Case No. 06-08-I) and Regular (Case No. 07-08-R) Variance. As of the date of filing, one of the three pilots is still operational, as are all three automatic ignition systems. The Petitioner has committed to offsetting any excess emissions, subject to APCD approval, that may occur during the variance period by implementing temporary mitigating options if a flare flame outage occurred that resulted in the venting of raw gas to the atmosphere.

1) Case No. 14-07-N (90- Day) – ExxonMobil Production Company, P.O. Box 4358, Houston, TX 77210-4358

Hearing – To consider an application by ExxonMobil Production Company (Petitioner) for a 90- Day Variance from District Rule 206, Conditions 9.C.17 and 9.C.8.(b)(ii) of Part 70 Permit to Operate 5651. The Petitioner operates the equipment for which variance relief is being requested at their Las Flores Canyon gas processing plant located approximately 25 miles northwest of Santa Barbara, California. In conformance with their permit requirements, the Petitioner operates a sulfur dioxide analyzer to monitor emissions from their waste gas incinerator. Condition 9.C.17 requires this analyzer to pass a Relative Accuracy Test Audit (RATA) once each calendar year. On March 17, 2007 the annual RATA was conducted; however, following Petitioner’s review of the test results it was determined that the analyzer failed to meet required standards. The Petitioner immediately sought and was granted Emergency Variance Order 10-07-E, which remained in effect until April 20, 2006. During the emergency variance period the Petitioner determined the cause for the failed analyzer test was due to a failed heated sample line. This line is a custom made-to-order part and will take 4-6 weeks to acquire. The Petitioner applied for and was granted Interim Variance Order 13-07-I on April 20, 2007; providing relief from enforcement action for up to 90 days or until the Hearing Board could consider Petitioner’s request for a 90-Day variance, whichever occurred first. The granting of Petitioner’s 90-Day variance request will not result in the generation of excess pollutant emissions.

2) Case No. 12-07-MSa (Modification of Schedule) – County of Santa Barbara Public Works (County), NEO Tajiguas LLC (NEO), and MM Tajiguas Energy LLC (MM Tajiguas), Tajiguas Landfill, 14470 Calle Real, Goleta, CA 93117

Hearing – To consider an application by the County, NEO and MM Tajiguas (Petitioner) for a Modification to the Schedule of Increments of Progress contained in Variance Order 02-07-R which was heard and approved on March 7, 2007. Petitioner has stated the schedule is unreasonable, and they are unable to meet the compliance dates. This hearing will be for the modification of the compliance deadlines to select and install control equipment to reduce the concentration of sulfur compounds (specifically hydrogen sulfide, H2S) in landfill gas prior to combustion.
