Gasoline Station Advisory for Stipulated Order of Abatement Process
Advisory
If you do not believe your gasoline station will be in compliance
with April 1, 2009 deadline to install Phase II EVR equipment, then
you may request that the District petition the APCD Hearing Board to grant
a Stipulated Order of Abatement. Your station will still be in
violation of Rule 316, but the Stipulated Order of Abatement will allow for
continued operations of your station until the Phase II EVR
equipment is installed. There will be two special Hearing
Board meetings, one in Santa Maria on March 18th, and the other
in Santa Barbara on March 25th. The Stipulated Order of

Forms
In order for the District to make this petition, the Responsible
Official for the gasoline station must complete the following two
forms. These two forms will be attached to the petition for
the Stipulated Order of Abatement, so please write very legibly and
have complete answers. We strongly recommend that your
proposed dates are realistic and reflect a timely compliance date.
Incomplete forms will not be accepted or processed.

Deadline to Submit the Forms
There are set deadlines to submit your request and the two
required forms. You cannot show up at the Hearing and expect
to be heard. The reason is that the District must prepare the
necessary documents for the Hearing Board and have them docketed
(i.e., submitted) two weeks in advance. Also, the District is
required to issue a public notice about the meeting and we must list your
station in the notice. You may request to have your case heard
at either Santa Maria or Santa Barbara and we will assume, unless
otherwise requested, that North County stations will have their
cases heard in Santa Maria and South County stations will have their
cases heard in Santa Barbara.
The deadline to submit your request to the District is noted
below. If you miss the Santa Maria deadline, then your case
will be heard in Santa Barbara. If you miss both deadlines,
then your case will not be filed.
