Existing Non-Compliance Situations

Q: Pursuant to Section D.1.c, the APCD reviews the existing permit(s) to ensure that permit conditions ensure compliance with, and enforceability of, applicable rules and regulations. If the review shows that compliance cannot be assured, Section D.1.d requires the permit to be revised prior to the transfer being approved. How does the permit get revised?

A: The APCD will inform the existing permit holder of the issues involved. The existing permit holder is required to submit an application to remedy the compliance issue.

Failure to File the Application

Q: What happens if the new permit owner/operator fails to file a transfer application within 30 days (as required by Section D.2)?

A: A Notice of Violation will be issued to the new owner/operator.
