Note to agricultural operators: View Draft Rule 213 below, and see recently adopted Rule 1201 on this page; these rules apply to diesel engines used in agricultural operations, specifically to stationary and portable diesel engines rated at 50 brake horsepower or greater. For more information, also see this page.

The following rules are in the rulemaking schedule for revision or adoption. Rules will be listed here in numerical order, with a description of the rule; the projected or actual hearing dates; the staff contact; and any related documents available (e.g., rule revisions, staff reports).

201 Permits Required – The Rule 201.D.2 provisions on exempting or permitting pile drivers, pipe-laying barges, and derrick barges is being relocated into Rule 202, Section F.7. The Rule 202.F.7 provision is expanded to include cable-laying and pipe-laying vessels. 202 Exemptions to Rule 201 (Amendments Associated with Revisions to Rule 333 - Engines)The major proposed changes to Rule 202, will:
  1. Require permits for spark ignition engines rated over 50 brake horsepower.
  2. Remove the exemption for construction engines and offshore well drilling engines.
  3. Require that derated equipment be permitted.
  4. Expand the powder coating exemption.
  5. Add a new exemption for wineries, breweries, and distilleries.

The emergency standby engine exemption will not be affected.

202 Exemptions to Rule 201 (Amendments Associated with the Adoption of New Rule 361 for Small Boilers) The revised Rule 202, Section G.1, lowers the permitting threshold from five (5) million British thermal units per hour to two (2) million British thermal units per hour. Motor Vehicle and Mobile Equipment Coating - This rule is currently being amended to incorporate the Suggested Control Measures for Automotive Coatings recently adopted by the state. The most significant components of this rule revision involve: separate volatile organic compound (VOC) limits for clear and color coatings (color coat VOC limit of 420 grams per liter);  simplified and combined coating categories, and a 25 gram per liter VOC limit for cleaning solvents. Rule 339 is scheduled for possible adoption in June 2008. Most elements of the new rule will take effect on January 1, 2009.

A second effort with this rule involves revisions to incorporate changes committed to in the 2001 and 2004 Clean Air Plans. The revised rule will include new control techniques to reduce solvent emissions.

1001 National Emissions Standards for Hazardous Air Pollutants (NESHAPs) (Revision) – Revise our National Emission Standards for asbestos to be more consistent with Ventura APCD’s (and other surrounding area Districts) asbestos rule rather than simply referring to the Federal NESHAPs (Part 61, Chapter I, Title 40 of the Code of Federal Regulations, Subpart M). Reg. XI Public Notification - Update regulation (originally adopted in 1980) to include current procedures to notify the public about exceedances of any primary air quality standards, and any associated health hazards. This regulation also includes guidelines for daily and annual reporting of air quality, and serves as a means to increase public awareness of air quality and involvement in the APCD’s clean-air efforts.
